The purpose of this Children's Online Privacy Policy is to describe what types of personal information Burger King Corporation may collect from children on a BKC Website, the purposes for which the information is used, what rights you have regarding personal information your child submits, and to whom and under what circumstances Burger King Corporation may disclose personal information. BKC Websites are operated by Burger King Corporation. Certain companies including, but not limited to, advertising, promotional, internet and public relations service providers (collectively, "Service Providers") assist BKC with respect to its websites. In this Children's Online Privacy Policy, Burger King Corporation and Service Providers are referred to collectively as "we" or "our." Burger King Corporation is the sponsor of a BKC Website. Certain non-personal information about visits to BKC Websites is recorded by the standard operation of the internet servers on which BKC Websites are hosted. The non-personal information that we collect may include IP addresses, the type of operating system in use (e.g., Macintosh or Windows), the type of browser being used by the visitor (e.g., Netscape or Internet Explorer), the number and frequency of visitors to BKC Websites, and the site the visitor was on immediately before visiting the BKC Website. We may offer children many fun features on BKC Websites such as games and screen savers that do not require children to provide any personal information. In using these features, however, Burger King Corporation may collect certain non-personal information from children by using small text files known as cookies. We use cookies for several purposes, such as to recognize visitors to our websites, to determine the number of unique visitors to our websites, to ascertain which website pages they visit, and to conduct internal reviews of our site. We may also use web beacons to count page visits by our users, to access our cookies, and otherwise to improve your experience on BKC Websites. If your child has registered to receive BK® Kids Club emails, we may also use web beacons in our HTML-based emails to let us know which emails the recipients have opened and acted upon, allowing us to gauge the effectiveness of our communications and marketing campaigns. Web beacons also help us manage online advertising, and are provided by our ad management Service Providers. These files enable our ad management Service Providers to recognize a unique cookie on your Web browser, which in turn enables us to learn which advertisements bring visitors to our website. The cookie was placed by us, or by another advertiser who works with a Service Provider. With both cookies and web beacons, the information that we collect and share is anonymous and not personally identifiable. It does not contain your name, address, telephone number, or email address. Our advertising Service Providers also use anonymous information about users' visits to this and other websites in order to deliver advertisements online that may be of interest to them. We may collect your child's email address to allow your child to send electronic postcards and other communications to third parties, such as friends. In order to send electronic postcards, children will be asked to provide their email address as well as the recipients' email addresses. All information collected for electronic postcards is used only to send the requested electronic postcard and is deleted from our system once the electronic postcard is sent. We may collect your child's e-mail address in order for him or her to enter into our sweepstakes or contests. If your child is selected as a potential winner, we will contact him/her at that email address and request your contact information so that we may fulfill the prize. All information collected for sweepstakes and contests is deleted from our system once the sweepstake or contest ends and prizes have been fulfilled, except if you have authorized us to maintain that information as part of the BK® Kids Club registration. In order for your child to register in the BK® Kids Club, we may collect the following information about your child: first name, last name, date of birth, gender, mailing address and email address. To ensure that your child's registration is compliant with the Children's Online Privacy Protection Act ("COPPA"), Burger King Corporation has engaged Privacy Vaults Online, Inc. ("Privo") to manage the BK® Kids Club registration. Privo will collect the personal information about your child on behalf of Burger King Corporation. The law prohibits Privo and Burger King Corporation from conditioning a child's participation in an activity on the child's disclosure of more personal information than is reasonably necessary to participate in that activity.

Privo will require you to create a parental account, known as the PrivoLock™ account, to permit your child to create an account and register with the BK® Kids Club. Privo requires a parent or guardian to set up a PrivoLock™ account to reasonably ensure that the individual providing the consent is an adult. Once the consent of a parent or guardian has been verified, the PrivoLock™ account allows the parent or guardian to maintain control over the child's BK® Kids Club account.

To set up a parental account, Privo may collect the parent's (or guardian's) first name, last name, mailing address, phone number, date of birth, gender, email address, and secret question (as a reminder for a forgotten password). Additionally, the parent or guardian will be asked to verify his or her identity by choosing an online verification method (such as partial social security number, driver's license, or credit card) or the parent may choose to fax/mail a signed form or phone the PrivoLock™ Registration Customer Service Center.

We may use the information collected about your child through the BK® Kids Club registration to inform children and parents about future BKC promotions, sweepstakes, contests, and other marketing activities. These promotions may include, but are not limited to, information about the BK® Kids Club, birthday parties, movie property tie-in's, toys, and new food products. Additionally, there may be areas of the BK.com/kids website that are available only for registered BK® Kids Club members.

During the registration process, children may choose to opt-in to promotional and/or website features. We allow parents (or guardians) to manage their children's personal information or opt-in preferences by clicking "Parents Manage Accounts" on the BK.com/kids website, or sign in to your PrivoLock™ account at www.PrivoLock.com. In this area, parents or guardians will be able to alter permissions, access the personally identifiable information that Privo has collected about their child, correct factual errors in such information, and request to have this information deleted or request that Privo or BK® Kids Club no longer collect, use or maintain such information. To protect the privacy and security of BK® Kids Club members online, Privo will take reasonable steps to verify the identity of the parent or guardian before granting the parent or guardian access to the personal information that we collect and maintain about the parent or guardian and his or her child.

Burger King Corporation may discontinue the BK® Kids Club and any related activities at any time and for any reason.

Burger King Corporation will transfer or otherwise disclose the information it collects from children to employees and independent contractors of Burger King Corporation, its subsidiaries, affiliates, and Service Providers if the disclosure will enable that party to perform a business, professional, or technical support function for Burger King Corporation, or if required to do so by law. We will also transfer or otherwise disclose personal information in response to judicial process, to comply with legal requirements, and, as permitted under provisions of law, to provide information to law enforcement agencies or in connection with an investigation on a matter related to public safety. We may also use the information as permitted by law to protect our rights or property, a BKC Website, or its users.
